Process Pro Funding Terms of Use
Effective date: October 12, 2026
These Terms of Use ("Terms") govern your use of processprofunding.com (the "Website"). Process Pro Funding is operated by Vinita, LLC, a Wyoming limited liability company with its office at 9801 Westheimer Road, Suite 300, Houston, Texas 77042, USA ("Process Pro Funding," "we," "us"). By using the Website, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Website.
1. Who we are
Process Pro Funding is an independent affiliate of David Allen Capital, a provider of business funding. We give small businesses general information about business funding and a link to apply with David Allen Capital. We are not an employee, agent or legal representative of David Allen Capital, and we cannot make promises or decisions for it.
2. We are not a lender
- We do not lend money, extend credit, buy receivables or provide any funding product.
- We are not a broker. We do not negotiate or arrange funding for you, and we do not act as your agent.
- We do not make credit decisions. Whether you qualify, how much you may receive and all rates, fees and terms are decided only by the funding provider, using its own criteria.
3. How we are paid
We receive a commission from David Allen Capital if a business we referred is funded. We are not paid for your visit, your inquiry or your application by itself. Applying is free to you, and our commission is not added to your rate or taken from your funding. Because we earn a commission, we have a financial interest in referring you to this partner. We currently refer businesses to one funding partner only, so the Website does not compare offers from other providers. Our Affiliate and Compensation Disclosure has more detail.
4. No guarantee of funding
Using the Website or applying does not guarantee that you will be approved, funded or offered any amount, rate, term or speed of funding. Any amounts, timelines or examples on the Website are general descriptions of products the funding provider may offer. They are not offers, quotes or commitments.
5. Information only
Everything on the Website is general information for business owners. It is not financial, legal, tax or accounting advice, and it is not a recommendation that any funding product is right for your business. Business funding has costs and risks. Read every offer and agreement in full, compare the total cost and repayment terms, and make sure you can afford the payments before you accept. The funding products described are for businesses and business purposes only, not for personal, family or household use, and may not be available in every state or for every type of business.
6. Third-party websites
When you click a link or button to apply, you leave the Website and go to David Allen Capital's website or another third-party site. That site, your application, the information you give in it and any funding offer are governed by that company's own terms and privacy policy, not these Terms. We do not control third-party websites and are not responsible for their content, decisions or practices.
7. Acceptable use
You agree not to:
- give false or misleading information, or apply in someone else's name or for a business you are not authorized to represent;
- use the Website for any unlawful or fraudulent purpose;
- try to access parts of the Website or our systems you are not authorized to use, or interfere with the Website's operation or security;
- send malware, spam or automated requests, or scrape or copy the Website by automated means; or
- copy or use our content, name or logos without our written permission.
8. Our content
The Website and its content, including text, graphics, logos and design, are owned by Vinita, LLC or its licensors. You may view and print pages for your own business use. "David Allen Capital" and its marks belong to their owner and are used only to identify our funding partner.
9. Disclaimer of warranties
The Website is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not promise that the Website will be uninterrupted, error-free or secure, or that information on it is complete or current.
10. Limitation of liability
To the fullest extent the law allows, Vinita, LLC and its members, managers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, business or data, arising from your use of the Website, any funding decision, or any offer, agreement or service from a funding provider. Our total liability for any claim relating to the Website is limited to one hundred U.S. dollars ($100). Some places do not allow these limits, so they may not apply to you in full.
11. Indemnity
You will defend and hold Vinita, LLC harmless from claims by third parties arising from your use of the Website, information you submit, or your breach of these Terms.
12. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute relating to these Terms or the Website will be brought only in the state or federal courts located in Harris County, Texas, and you consent to the jurisdiction of those courts.
13. Changes
We may update these Terms by posting a new version with a new effective date. Your continued use of the Website after a change means you accept the updated Terms.
14. General
If any part of these Terms is unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. These Terms, our Privacy Policy, our Affiliate and Compensation Disclosure and our Not a Lender Disclaimer are the entire agreement between you and us about the Website.
